Welcome to Poppy Mountain Gems. These Terms of Service govern your access to and use of PoppyMountainGems.com, including purchases made through the website.
Throughout these Terms, “Poppy Mountain Gems,” “we,” “us,” and “our” refer to Poppy Mountain Gems. “You” and “your” refer to the person accessing the website or purchasing our products.
By visiting our website, placing an order, or otherwise using our services, you agree to these Terms of Service, our Privacy Policy, Shipping Policy, Exchanges & Returns Policy, and other applicable policies posted on the website. If you do not agree with these Terms, please do not use the website.
Eligibility
You must be at least the age of legal majority in your state or jurisdiction to make a purchase through this website. By placing an order, you represent that you are legally able to enter into a binding agreement and that the information you provide is accurate and complete.
You may not use our products or website for any unlawful or unauthorized purpose.
Handmade Nature of Our Jewelry
Poppy Mountain Gems jewelry is handcrafted using the gemstones, pearls, metals, leather, sea glass, shells, and other materials described in individual product listings.
Because our jewelry is handmade and often incorporates natural materials, slight variations in color, shape, size, texture, pattern, finish, and placement are expected. These variations are part of the character of handmade jewelry and do not ordinarily constitute defects.
Product photographs are intended to represent each item as accurately as possible. Colors and details may appear differently depending on lighting, photography, screen settings, and the natural characteristics of the materials.
Product Descriptions and Materials
We make reasonable efforts to describe our products, materials, measurements, colors, and finishes accurately. Measurements are approximate, and minor variations may occur.
Natural gemstones, pearls, shells, sea glass, leather, and metals may contain variations, inclusions, markings, or irregularities. These characteristics are part of their natural beauty.
Information about gemstones, metals, pearls, or other materials is provided for general identification and product-description purposes. Unless expressly stated otherwise, our descriptions are not professional appraisals, certifications, or guarantees of investment value.
If a gemstone or other material has received a treatment that requires special care and that treatment is known to us, we will make reasonable efforts to disclose it in the applicable product description or care information.
Product Availability
All products are subject to availability. Some pieces may be one of a kind or may become unavailable without notice.
We reserve the right to limit product quantities, discontinue a product, or modify a design. We may also limit sales to particular individuals, households, geographic regions, or jurisdictions when reasonably necessary.
Placing an item in your cart does not reserve it. A product is not secured until your order has been successfully submitted and accepted.
Prices, Taxes, and Promotions
Prices are listed in U.S. dollars and may change without notice. The price charged will be the price displayed when your order is submitted, subject to the correction of genuine pricing or listing errors.
Applicable sales tax will be calculated during checkout when required.
Discount codes and promotions must be used according to their stated terms. They cannot be applied after an order has been submitted or combined unless expressly permitted. Discount codes have no cash value and may be modified or discontinued, subject to applicable law.
If a product is mistakenly listed at an incorrect price or with incorrect information, we may contact you to offer the option of proceeding with the corrected information or canceling the affected item for a full refund.
Orders and Order Acceptance
After you place an order, you may receive an electronic confirmation. This acknowledges that we received your order but does not necessarily mean it has been accepted.
We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, unauthorized activity, payment problems, incorrect pricing or product information, shipping restrictions, errors in customer or delivery information, orders that appear intended for unauthorized resale, or violations of these Terms.
If we cancel an order after payment has been collected, we will issue a refund for the canceled portion.
Payment
Payment is due when an order is submitted. Available payment methods are displayed during checkout.
Payments are processed by third-party payment providers. Poppy Mountain Gems does not directly receive or store your complete payment-card information.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges, including the purchase price, taxes, shipping charges, and other amounts shown during checkout.
Order Changes and Cancellations
If you need to change or cancel an order, email jane@poppymountaingems.com within 12 hours of placing it.
We will make reasonable efforts to accommodate your request, but cancellation or modification is not guaranteed once an order has entered production, been packaged, or shipped. Custom, personalized, altered, or made-to-order work may not be canceled after materials have been ordered specifically for the piece or work has begun.

Custom and Personalized Orders
Custom, personalized, custom-sized, altered, and specially commissioned pieces may require additional production time. Separate pricing, deposits, design approvals, or other terms will be communicated before work begins when applicable.
Unless an item arrives damaged, incorrect, or otherwise qualifies for a legal remedy, custom and personalized orders are final sale and cannot be returned or exchanged.
Natural variations and reasonable differences resulting from handmade production are not ordinarily considered defects.
Processing and Shipping
Poppy Mountain Gems currently ships within the United States.
Most in-stock orders are prepared for shipment within 2–5 business days, unless a different processing time is stated in the product description or communicated to you. Orders are generally shipped through USPS Ground Advantage, with an estimated additional 2–5 business days after shipment.
Delivery estimates are not guaranteed and may be affected by carrier delays, weather, holidays, service disruptions, or other circumstances outside our control.
Shipping charges and available delivery options are displayed during checkout. Qualifying United States orders of $200 or more after discounts and before applicable taxes receive complimentary standard shipping.

Shipping Delays
We make reasonable efforts to ship orders within the time stated on the website or in your order confirmation.
If we become unable to ship within the promised time, we will notify you and provide the option to agree to the delay or cancel the affected portion of the order for a refund, as required by applicable law.
Once a package is transferred to the shipping carrier, tracking updates and delivery timing are controlled by the carrier. Please contact us if tracking has not updated for an extended period so we can help investigate.
Shipping Addresses
You are responsible for providing a complete and accurate shipping address. If you notice an error, contact us as soon as possible. We cannot guarantee an address change after an order has been processed or shipped.
If a package is returned because of an incorrect, incomplete, or undeliverable address, we will contact you. Additional shipping charges may apply before the order can be resent.
Original shipping charges paid by the customer are generally nonrefundable unless the problem resulted from our error.
Tracking and Delivered Packages
Tracking information will be sent to the email address associated with your order.
If tracking shows that a package was delivered but you cannot locate it, verify the shipping address and check around the delivery location. Ask household members, neighbors, or building staff whether they accepted the package.
Please allow up to three business days, as some packages may be scanned before final delivery. If the package still cannot be located, contact us so we can review the circumstances and help determine the appropriate next steps. You may also contact your local USPS office for delivery details.
Lost or Damaged Packages
If a package appears lost in transit, please contact us. We may ask you to cooperate with a carrier investigation or provide supporting information.
If your order arrives damaged, incorrect, or incomplete, contact us within three days of delivery. Include your name, order number, a description of the problem, clear photographs of the item, and photographs of the packaging and shipping label when applicable.
Retain the item and all packaging until we have reviewed the issue.
Depending on the circumstances and product availability, we may offer a repair, replacement, refund, or another appropriate remedy. Nothing in this section limits rights or remedies available under applicable law.
Returns and Exchanges
Eligible, noncustom items may be returned or exchanged according to the time frames, conditions, and exclusions in our Exchanges & Returns Policy.
Contact us within seven days of delivery and receive authorization before mailing an item. The approved return must be mailed within 14 days of delivery.
Returned items must be unworn, unused, unaltered, and in their original condition. Items returned without prior authorization may not be accepted.
Unless the return results from our error or an item arriving damaged or defective, the customer is responsible for return-shipping costs. We recommend a trackable shipping method and insurance for higher-value items. The customer is responsible for the return package until it is delivered to us.
Nonreturnable Items
The following items are generally not eligible for return or exchange:
- Custom or personalized jewelry
- Custom-sized or altered pieces
- Made-to-order pieces created to the customer’s specifications
- Earrings and other pierced jewelry, for hygiene reasons
- Gift cards
- Clearance or final-sale items
- Products specifically marked as nonreturnable
- Items that have been worn, damaged, altered, or improperly stored
- Items returned outside the stated return period
- Items missing original parts or components
These exclusions do not apply when an item arrives damaged, incorrect, or otherwise qualifies for a remedy under applicable law.
Refunds
Approved refunds are generally processed within 5–7 business days after the returned item is received and inspected. Refunds will ordinarily be issued to the original payment method. Your bank or payment provider may require additional time to post the refund.
Original shipping charges paid by the customer and expedited-shipping charges are generally nonrefundable unless the return is due to our error, the item arrived damaged or incorrect, or a refund is otherwise required by law.

Exchanges
Approved exchanges are subject to product availability.
If the replacement item costs more than the original item, you will be responsible for the difference. If it costs less, the eligible difference will be refunded.
Customers are generally responsible for return shipping and shipping the replacement item unless the exchange is necessary because of our error or a damaged or defective product.
Gifts
Gift recipients may contact us regarding an eligible return or exchange. Proof of purchase may be required.
Approved gift returns may be issued as store credit or an exchange. Refunds to the original payment method can be provided only to the original purchaser unless otherwise required by law.
Repairs
Repair availability and cost depend on the item’s age, condition, construction, and material availability.
Please contact us with photographs and a description of the issue before sending an item. Repair services are not guaranteed for every product. Shipping costs, replacement materials, and repair fees may apply.
Damage caused by misuse, impact, exposure to chemicals or water, improper storage, normal wear, or failure to follow recommended care instructions is not considered a manufacturing defect.
Jewelry Care
Jewelry requires appropriate care to preserve its appearance and structure. Certain materials may naturally change, tarnish, soften, stretch, fade, or develop a patina over time.
Please review our Jewelry Care page before wearing or cleaning your jewelry. Care recommendations vary depending on the materials, finishes, and construction methods used in a piece.
Poppy Mountain Gems is not responsible for damage resulting from improper cleaning, storage, handling, modification, or use contrary to the provided care guidance.
Metal Sensitivities and Allergies
Product descriptions identify materials to the best of our knowledge. Individual sensitivities and allergic reactions vary.
Please review the listed materials and determine whether a product is suitable for you. If you have a known metal, leather, adhesive, or other material sensitivity, contact us before purchasing.
Discontinue wearing an item that causes irritation or discomfort and consult an appropriate healthcare professional when necessary.
Jewelry Safety
Jewelry may contain small parts and is not intended for babies or young children. It should not be placed in the mouth or used as a toy.
Remove jewelry before sleeping, bathing, swimming, exercising, participating in sports, or activities where it could catch, break, or cause injury.
Some jewelry may present choking, strangulation, or entanglement hazards. Customers are responsible for using and storing jewelry safely.

For every Anchor Collection piece sold, Poppy Mountain Gems donates $5 to the Colorectal Cancer Alliance, supporting lifesaving research, early detection, and services for patients and their families.

Unless expressly stated otherwise, purchasing a product is not a tax-deductible charitable donation by the customer. Poppy Mountain Gems does not provide tax advice or guarantee the tax treatment of a purchase.
Gift Cards
If gift cards are offered, they may be used only for eligible purchases through Poppy Mountain Gems and are not redeemable for cash except where required by law.
Gift cards should be treated like cash. Poppy Mountain Gems is not responsible for a lost, stolen, or improperly used gift card except as required by law. Additional gift-card terms may be displayed at the time of purchase.
Website Accounts
If account registration is available, you are responsible for providing accurate information, maintaining the confidentiality of your login credentials, restricting access to your account, and promptly notifying us of suspected unauthorized use.
You are responsible for activity conducted through your account to the extent permitted by law. We may suspend or terminate an account that appears compromised, used fraudulently, or used in violation of these Terms.
Acceptable Use
You agree not to:
- Use the website for unlawful, fraudulent, or abusive purposes
- Interfere with the website’s operation or security
- Attempt to gain unauthorized access to accounts, systems, or data
- Upload or transmit malware, viruses, or harmful code

If you submit a review, testimonial, photograph, comment, or other content for publication, you represent that you created it or have permission to submit it.

You retain ownership of your original content. By submitting content specifically for publication, you grant us a nonexclusive, worldwide, royalty-free license to reproduce and display that content for its intended purpose, subject to applicable law.
Tagging Poppy Mountain Gems on social media does not automatically grant permission for promotional reuse. We will ask for permission before reposting tagged photographs or using them in marketing.
We may remove or decline to publish submitted content at our discretion. We are not obligated to compensate you unless we agree otherwise in writing.
Feedback and Suggestions
If you voluntarily provide ideas, suggestions, or feedback about our products or business, we may use that feedback without restriction or compensation, provided this does not violate applicable law or an express written agreement.
Please do not submit confidential business ideas or proprietary information through general feedback channels.

If a product listing contains product-specific terms, those terms control to the extent of a direct conflict relating to that product.
